Understanding VAT on Real Estate Commissions

In many jurisdictions (such as the UK, European Union, UAE, and South Africa), real estate brokerage services are subject to Value Added Tax (VAT) or Goods and Services Tax (GST). Depending on how commission agreements are structured, the stated commission rate may be quote exclusive of VAT (where tax is added on top) or inclusive of VAT.

Calculating VAT on Commission

The calculations depend on the tax status of the agreed commission rate:

  • VAT Exclusive: $$\text{Base Commission} = \text{Sale Price} \times \text{Commission Rate}$$ $$\text{VAT} = \text{Base Commission} \times \text{VAT Rate}$$ $$\text{Total Payable} = \text{Base Commission} + \text{VAT}$$
  • VAT Inclusive: $$\text{Total Payable} = \text{Sale Price} \times \text{Commission Rate}$$ $$\text{Base Commission} = \frac{\text{Total Payable}}{1 + \text{VAT Rate}}$$ $$\text{VAT} = \text{Total Payable} - \text{Base Commission}$$
